Usage Agreement Introduction

Welcome to cfmoto.qa, the official website for CFMOTO, the exclusive authorized distributor of CFMOTO motorcycles in Qatar. These Terms and Conditions, together with our Privacy Policy (collectively, the “Agreement”), govern your use of our website, mobile application, and related services (collectively, the “Platform”). By accessing or using the Platform, including browsing, registering, or purchasing products, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.

This Agreement is effective upon your use of the Platform and is legally binding in accordance with applicable laws of Qatar, including Qatar’s Electronic Commerce and Transactions Law (Law No. 16 of 2010). If you are not at least 18 years of age or do not agree with any part of this Agreement, you must immediately discontinue use of the Platform.

Article One: Definitions

The following terms used in this Agreement have the meanings specified below:

Store/Platform: Refers to cfmoto.qa, including its website, mobile application, or any other digital interface operated by CFMOTO in Qatar.
Consumer/User: Refers to an individual or entity who uses the Platform to browse or purchase CFMOTO motorcycles or related services.
Agreement: Refers to these Terms and Conditions and the Privacy Policy, which govern the legal relationship between the Store and the Consumer.
Product: Refers to CFMOTO motorcycles and related accessories offered for sale on the Platform.

Article Two: Legal Capacity

The Consumer affirms that they have the legal capacity to enter into transactions on the Platform, as recognized by the laws of Qatar, and are at least eighteen (18) years of age.
The Consumer acknowledges that any breach of this article, including misrepresentation of age or authority, shall render them solely liable for any resulting consequences or liabilities towards third parties or the Store.

Article Three: Purchase and Payment

Order Placement: All orders placed through the Platform are subject to acceptance by the Store. The Store reserves the right to reject any order at its sole discretion, with notification provided to the Consumer.
Pricing: Prices for Products are displayed in Qatari Riyal (QAR) and are inclusive of applicable taxes unless otherwise stated. The Store reserves the right to modify prices at any time without prior notice, but such changes will not affect confirmed orders.
Payment: Payments must be made in full at the time of order placement using the payment methods available on the Platform. All transactions are processed securely through trusted payment gateways.

Article Four: Delivery Policy

Delivery Location: Delivery of Products is available exclusively within the State of Qatar.
Delivery Timeline: Upon receipt of full payment, the Store will process the order, complete ownership transfer, and deliver the Product to the Consumer’s specified location within 2-3 working days, subject to verification of payment and availability of the Product.
Delivery Conditions: The Consumer must provide accurate delivery details and ensure someone is available to receive the Product. Additional charges may apply for failed delivery attempts due to incorrect information or unavailability.
Ownership Transfer: Ownership of the Product transfers to the Consumer upon completion of the registration process with the relevant Qatari authorities and delivery of the Product.

Article Five: Cancellation Policy

Cancellation by Consumer:
- Orders may be canceled by the Consumer within 24 hours of placement by contacting the Store’s customer service at +974 41418484, +974 77599598, or info@cfmoto.qa
- A cancellation fee, including applicable bank or payment processing charges (e.g., 3% of the transaction amount or as determined by the payment provider), will be deducted from any amount returned to the Consumer.
- No cancellations are permitted after 24 hours or once the ownership transfer process has begun.
- No refunds are offered for any cancellations or purchases under any circumstances, except as required by applicable Qatari law.
Cancellation by Store: The Store reserves the right to cancel an order due to stock unavailability, payment issues, or other unforeseen circumstances. In such cases, the Consumer will be notified, and any payments made will be returned without deduction of bank charges, subject to bank processing times.
Non-Returnable Items: All Products, including customized Products or Products damaged after delivery due to Consumer mishandling, are non-returnable and non-refunded.

Article Six: Privacy Policy

Data Collection: The Store collects personal information (e.g., name, contact details, payment information, and delivery address) provided by the Consumer during registration, order placement, or other interactions with the Platform.
Purpose of Data Use:
- To process orders, facilitate delivery, and complete ownership transfer.
- To communicate with the Consumer regarding their order or inquiries.
- To comply with legal obligations under Qatari law.
- For internal business purposes, such as improving our services (anonymized data may be used).
Data Protection: The Store employs industry-standard security measures to protect Consumer data from unauthorized access, disclosure, or misuse. However, no online platform can guarantee absolute security.
Data Sharing: Personal information will not be shared with third parties except:
- With trusted service providers (e.g., payment processors, delivery companies) necessary to fulfill orders.
- To comply with legal or regulatory requirements.
- With the Consumer’s explicit consent.
Consumer Rights: Consumers may request access to, correction of, or deletion of their personal data by contacting info@cfmoto.qa (mailto:info@cfmoto.qa), subject to legal limitations.
Cookies: The Platform uses cookies to enhance user experience and track website performance. Consumers may disable cookies in their browser settings, but this may limit Platform functionality.

Article Seven: Warranties and Liability

Product Warranty: CFMOTO motorcycles are covered by the manufacturer’s warranty, details of which are provided with the Product. The Store is not liable for damages resulting from misuse, unauthorized modifications, or failure to follow maintenance guidelines.
Liability Limitation: To the extent permitted by Qatari law, the Store’s liability for any claim arising from the use of the Platform or purchase of Products is limited to the amount paid by the Consumer for the Product in question.
Accuracy of Information: The Store strives to ensure that all Product descriptions, images, and prices on the Platform are accurate. However, errors may occur, and the Store is not bound by such errors.

Article Eight: Intellectual Property

All content on the Platform, including logos, images, text, and designs, is the property of CFMOTO or its licensors and is protected by intellectual property laws.
Consumers may not reproduce, distribute, or use any content from the Platform without prior written consent from the Store.

Article Nine: Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Qatar.
Any disputes arising from this Agreement or use of the Platform shall be resolved amicably through negotiation. If unresolved, disputes shall be referred to the competent courts in Doha, Qatar.

Article Ten: Miscellaneous

Amendments: The Store reserves the right to modify this Agreement at any time. Changes will be effective upon posting on the Platform, and continued use constitutes acceptance of the updated terms.
